The housing technical sheet: what changed at the deed

Since 1 January 2024 the seller no longer has to produce the ficha técnica da habitação or the use permit when ownership is transferred: Decreto-Lei n.º 10/2024 repealed artigo 9.º do Decreto-Lei n.º 68/2004. The documents did not go away — the formality did, not the duty to have them.

What was repealed

Decreto-Lei n.º 10/2024 removed artigo 9.º do Decreto-Lei n.º 68/2004, the rule that required the handover of the technical sheet to be stated at the deed. Drawing the sheet up is still required: Decreto-Lei n.º 68/2004 stands.

The same change covers the use permit: it is no longer presented at the transfer. That does not make it lawful to occupy a building without one.

What to do before you sign

Ask for the technical sheet before the promissory contract. Whoever markets the property — developer, agency or another professional — must keep a copy of the sheet, or of its provisional version, where buyers are received and the property is sold.

Check it against what you see. Information that does not match the real characteristics of the dwelling is an administrative offence, and IMPIC is the body that investigates it.
